2. Until when does the system apply?
|
By the end of 2026 or until the entry into force of national legislation. In the absence of the adoption of the applicable law, it is planned to extend the compensation system for the next year on similar terms.

3. On what basis was the amount of compensation for Fishing Vessel Owners calculated?
|
Compensation for the inability to obtain income from the investment area based on the scale of historical catches will be calculated on the basis of official catch data from the register of the Fisheries Monitoring Centre for the period 2018-2024 for each vessel separately. The largest annual catch of a vessel in the investment area during the period 2018-2024 will be taken into account. The catch of each fish species will be converted to the "common denominator", i.e. the price equivalent of cod in kilograms at 2024 prices (the table with the values can be found in the Regulations).
Alternatively, compensation is also available for not being able to earn income from the investment area based on the length of the hull.
Compensation for additional difficulties resulting from carrying out construction works at sea is calculated on the basis of the length of the hull, taking into account factors such as: increased distance to the fishery, increased wear and tear of the vessel, longer work of the crew, higher fuel consumption. The amount of compensation varies depending on the hull length.

4. On what basis was the amount of compensation for Commercial Angling Yacht Owners calculated?

Compensation for Commercial Yacht Owners engaged in fishing activities is calculated on the basis of historical data on fishing activity and the estimated share of revenues from the MFW area and export cable route to the total revenues in a given year.

5. Which category of compensation should be indicated in the application?
|
If the right to compensation is granted, the Shipowner will receive a draft Agreement containing the highest possible Compensation, if the documents submitted by the Shipowner with the application show that he is entitled to compensation on a different basis than indicated in the application.
Fishing vessel owners:
If the Shipowner applies for compensation on the basis of historical fishing activity in fishing squares L8, M8, N7, N8, O6, O7 or transit to fishing squares M9 and M10, it should tick one of the categories A, B, C, D or F on the basis of the Regulations and attach the relevant annexes to the application.
After submitting the application, the Shipowner's fishing data will be verified. If the fishing data show that the Shipowner is entitled to compensation from a different category than the one indicated, he will be offered the higher of the compensation regardless of the category he has indicated in the application.
If the Shipowner applies for compensation on the basis of the port, it should mark category E on the basis of the Terms and Conditions and attach the relevant annexes to the application.
Commercial angling yacht owners:
If the Shipowner applies for compensation on the basis of catch reports, he should mark category G on the basis of the Regulations and attach the relevant annexes to the application.
If the Shipowner applies for compensation on the basis of a certificate of angling activity, it should mark category H on the basis of the Terms and Conditions and attach relevant attachments to the application.
If the Shipowner attaches to the application a certificate of catch reports and a certificate of angling activity, he will be offered the higher of the compensation, regardless of the category he has indicated in the application.

6. How to apply? |

The application can be submitted in person or by proxy (with the attached document of the power of attorney).
In the case of co-shipowners – each shipowner submits an application separately.
Fishing vessel owners should attach to the application:
• Special fishing authorisations for 2025 and 2026
• power of attorney to check the Shipowner's data in the CMR register (in the case of applying for compensation on the basis of catches)
• Port of station confirmation document in 2025 (in the case of applying for port compensation)
Commercial angling yacht owners should attach to the application:
• a copy of the vessel registration document or ship safety card from any period between 2018 - 2024
• document confirming the port of stationing of the vessel in the years 2018-2024 (in the case of owners of recreational vessels)
• Extract from the National Court Register, CEiDG, other proof confirming the performance of commercial fishing activity
• certificate from the Chief Inspectorate of Sea Fisheries (in the case of applying for compensation on the basis of catch reports)
• a certificate from the Harbourmaster's Office or the Maritime Office (in the case of applying for compensation on the basis of the port from which the fishing activity was conducted)
